By accessing or using the HearthWords website and applications, you agree to these terms. If you don't agree, please don't use our services.
1. What HearthWords Is
HearthWords - Kids Tap & Learn is an educational application designed to help children discover vocabulary through personalized photo galleries with audio recordings. The website, web application, and mobile applications are provided for educational purposes.
2. What HearthWords Is Not
HearthWords is not professional advice or treatment of any kind. It is not:
- A medical device or medical treatment
- A therapeutic intervention
- An Augmentative and Alternative Communication (AAC) device
- An Applied Behavior Analysis (ABA) tool
- Speech therapy or a substitute for speech therapy
- A diagnostic tool for any condition
- A substitute for professional evaluation or treatment
3. Professional Guidance Required
A qualified healthcare provider, speech-language pathologist, therapist, or educator may determine that HearthWords is appropriate for specific therapeutic or educational purposes; however, such determination is solely within the discretion of the recommending professional.
If your child has speech, language, developmental, or learning concerns, consult a qualified professional. HearthWords is not designed to diagnose, treat, cure, or prevent any medical condition or developmental delay.
4. Your Responsibility
You are solely responsible for:
- Supervising your child's use of HearthWords
- Determining whether HearthWords is appropriate for your child
- The content you add to the application (photos, audio recordings)
- Seeking professional advice when needed
Using HearthWords does not create any professional relationship between you and Hamilton B. Barber.
5. No Guarantees
We make no guarantees about:
- Educational outcomes or vocabulary development
- The suitability of the app for any particular child or purpose
- The availability or functionality of the website or applications
- The preservation of your data (please export/backup regularly)
The application is provided "as is" without warranties of any kind, express or implied.
6. Limitation of Liability
To the fullest extent permitted by law, Hamilton B. Barber shall not be liable for any damages arising from:
- Your use of or inability to use HearthWords
- Any educational or developmental outcomes
- Decisions you make based on using the application
- Loss of data or content you create in the application
- Any errors, bugs, or interruptions in service
This limitation applies to direct, indirect, incidental, consequential, and punitive damages.
7. Intellectual Property
HearthWords and "Kids Tap & Learn" are trademarks of Hamilton B. Barber. The application code, design, and website content are protected by copyright.
Content you create (photos, audio recordings) remains yours. By using the app, you grant us no rights to your personal content.
8. Acceptable Use
You agree not to:
- Use HearthWords for any unlawful purpose
- Attempt to reverse engineer or modify the applications
- Use automated tools to access or scrape the website
- Upload inappropriate or harmful content
9. Children's Use
HearthWords is designed for use by children under adult supervision. Parents or guardians are responsible for all use by minors. We do not knowingly collect personal information from children (see our Privacy Policy).
10. Changes to These Terms
We may update these terms from time to time. Changes take effect when posted. Continued use after changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.
